Adios Miranda
On June 13, 1966 the United States Supreme Court in a landmark decision decided Miranda v. Arizona, 384 U.S. 436 (1966) which afforded rights n1 to suspects who are questioned by the police. With a 5 - 4 decision it is no wonder that these once preserved rights have splintered. This one day seminar will examine the rights originally established and the significant cases over the 44 years that continue to water down the precedent setting case which passed by only a bare majority.
n1 – “…must be warned prior to any
Questioning that he has the right to remain silent, that anything he says can be used against him in a court of law, that he has the right to the presence of an attorney, and that if he cannot afford an attorney one will be appointed for him prior to any questioning if he so desires.
Opportunity to exercise these rights must be afforded to him throughout the interrogation.” Id @ 479
